Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Coastal Labs Studio LLC ("CoastalLabs," "Company," "we," "our," or "us"), a California limited liability company, concerning your use of the TankSync mobile application (the "App") and related services.

By downloading, installing, or using TankSync, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

TankSync is a mobile application designed to help aquarium enthusiasts manage their aquarium care, including:

• Water parameter tracking and monitoring
• Fish, plant, and equipment management
• Maintenance scheduling and reminders
• AI-powered insights and recommendations (Pro version)
• Data visualization and analytics
• Photo storage and aquarium journaling

The App is available in both free and premium (Pro) versions, with additional features available through in-app purchases.

User Accounts

Account Creation

You may create an account to access cloud synchronization and premium features. When creating an account, you must:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Use the App only for lawful purposes

Account Responsibility

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree to use TankSync only for its intended purpose and in compliance with all applicable laws. You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Upload malicious code or attempt to compromise App security
• Share your account credentials with others
• Use the App to harm or endanger aquatic life
• Violate any local, state, national, or international law

Subscription and Payments

TankSync Pro

TankSync Pro is available through auto-renewable subscription purchases made through the Apple App Store. Key terms include:

• Billing: Subscriptions are billed through your Apple ID account
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
• Cancellation: You can cancel your subscription anytime through your Apple ID account settings. Cancellation takes effect at the end of the current paid period
• Refunds: Refund requests are handled according to Apple's refund policy. We do not process refunds directly for App Store purchases
• Free Trials: If a free trial is offered, it converts to a paid subscription unless canceled before the trial ends

Price and Feature Changes

We reserve the right to modify subscription prices and the features included in the free and Pro tiers. Price changes will not affect existing subscribers until their next renewal period, and we will provide notice of any changes as required by the App Store. Where Apple requires it, a price increase takes effect only after you are notified and, where applicable, consent to the new price; if you do not agree, your subscription will not renew at the increased price.

Features may be added, changed, or removed over time, and we do not guarantee that any particular feature will remain available for the life of your subscription. If we materially reduce Pro functionality during your current paid period, you may cancel your subscription and may request a refund from Apple in accordance with Apple's refund policy.

Intellectual Property Rights

Our Rights

TankSync, including its design, functionality, code, and content, is owned by CoastalLabs and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Your Content

You retain ownership of all content you create in TankSync (aquarium data, photos, notes, etc.). By using the App, you grant us a limited license to process and store your content to provide App functionality, including cloud synchronization and AI features.

Disclaimers and Limitations

Educational Purpose

IMPORTANT: TankSync is designed as an educational and organizational tool. While we strive to provide accurate information and helpful recommendations, the App should not be considered a substitute for professional aquarium consultation or veterinary advice.

No Guarantee of Results

We make no guarantees about the health or survival of your aquatic life based on using TankSync. Aquarium keeping involves inherent risks, and results may vary based on numerous factors beyond the App's control.

AI Recommendations

AI-powered recommendations are based on general aquarium principles and should be considered suggestions, not absolute requirements. Always use your judgment and consult with experienced aquarists or professionals when in doubt.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT RESPONSIBLE FOR LOSS OF AQUATIC LIFE, EQUIPMENT DAMAGE, OR RELATED COSTS

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless CoastalLabs and its affiliates, officers, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms or applicable laws, or your infringement of any third-party right.

Data and Privacy

Your privacy is important to us. Our data collection and use practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

Data Backup

While we provide cloud synchronization services, you are responsible for maintaining your own backups of important data. We recommend regularly exporting your aquarium data as a precaution.

Service Availability

We strive to maintain high App availability, but we do not guarantee uninterrupted service. We reserve the right to:

• Modify or discontinue features with reasonable notice
• Perform maintenance that may temporarily affect availability
• Suspend service in case of technical issues or security concerns

Termination

By You

You may stop using TankSync at any time. To delete your account and data, use the account deletion feature in the App or contact us directly.

By Us

We may terminate or suspend your access to TankSync if you violate these Terms or engage in prohibited activities. We will provide reasonable notice when possible.

Effect of Termination

Upon termination, your right to use TankSync ceases immediately. Data deletion will be handled according to our Privacy Policy.

Changes to Terms

We may modify these Terms from time to time. When we make significant changes, we will:

• Post the updated Terms on our website
• Update the "Last updated" date
• Provide in-app notifications for material changes
• Give you reasonable time to review changes before they take effect

Continued use of TankSync after changes become effective constitutes your acceptance of the new Terms.

Apple App Store Terms

If you obtained TankSync through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and CoastalLabs only — not Apple. Apple is not responsible for the App or its content.
• Your use of the App must comply with the Apple Media Services Terms and Conditions and any usage rules established by Apple.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution

Before filing any legal action, we encourage you to contact us directly to resolve any disputes. Most issues can be resolved through direct communication.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoastalLabs regarding TankSync and supersede any prior agreements on the same subject.
