Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Coastal Labs Studio LLC ("CoastalLabs," "Company," "we," "our," or "us"), a California limited liability company, concerning your use of the GoVenture mobile application (the "App") and related services.

By downloading, installing, or using GoVenture, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

Description of Service

GoVenture is a mobile application that helps users plan, manage, and record outdoor trips. Features include:

• Trip itineraries, schedules, and waypoint management
• Route browsing, planning, and attachment to trips
• GPS route recording during outdoor activities
• Gear lists, packing kits, and per-trip gear assignments
• Group trips, member coordination, and trip sharing
• Permit tracking, float plans, and emergency contact information
• Adventure groups and a feed of public routes shared by other users
• Weather forecasts for planned waypoints
• Optional integration with Apple Health for activity data
• Photo storage tied to trips and waypoints

The App is offered in both a free tier and a premium ("GoVenture Pro") tier through in-app purchase.

User Accounts

Account Creation

An account is required to use most features of GoVenture, including cloud sync, group trips, and public route sharing. You may sign in with Apple, Google, or email. When creating an account, you must:

• Provide accurate and complete information
• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Maintain the security of your account credentials
• Use the App only for lawful purposes

Account Responsibility

You are responsible for all activity that occurs under your account, including content you create, trips you share, and routes you publish. You agree to notify us immediately of any unauthorized use of your account.

Profile Information

If you choose to make your profile public, your username, display name, avatar, bio, and public activity may be visible to other users. You can adjust visibility at any time in the App's privacy settings.

Acceptable Use

You agree to use GoVenture only for its intended purpose and in compliance with all applicable laws, regulations, and land-use rules. You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal, harmful, or unauthorized purpose
• Attempt to gain unauthorized access to our systems, data, or other users' accounts
• Upload malicious code, scrape data at scale, or otherwise compromise App security
• Share your account credentials or impersonate another person
• Upload content that is unlawful, defamatory, harassing, hateful, or infringes on others' rights
• Publish routes or trip plans that knowingly trespass, violate land-use rules, or expose sensitive ecological, archaeological, or culturally significant sites
• Use the App to stalk, surveil, or share another person's location without their informed consent
• Misrepresent route difficulty, conditions, or hazards in ways that could endanger others
• Use the App in any way that violates local, state, national, or international law

Outdoor Ethics and Land Use

GoVenture is built for the outdoor community, and we expect users to act accordingly. When using the App, you agree to:

• Follow Leave No Trace principles
• Respect land-management agency rules, including permit requirements, seasonal closures, fire restrictions, and group size limits
• Stay on established trails where required and respect private property, Indigenous lands, and protected areas
• Avoid publishing routes through sensitive habitats, protected wildlife areas, or sites where increased visitation would cause harm
• Respect other users in groups, comments, and shared content

We reserve the right to remove content or routes that conflict with these principles or applicable laws.

Subscription and Payments

GoVenture Pro

GoVenture Pro is offered as an auto-renewable subscription through the Apple App Store. Pro unlocks features such as route drawing, unlimited gear lists, offline maps, additional map styles, gear weight tracking, and other premium capabilities. Key terms include:

• Billing: Subscriptions are billed through your Apple ID account.
• Auto-Renewal: Subscriptions automatically renew at the end of each period unless canceled at least 24 hours before the current period ends.
• Cancellation: You can cancel your subscription anytime through your Apple ID account settings. Cancellation takes effect at the end of the current paid period.
• Refunds: Refund requests are handled according to Apple's refund policy. We do not process refunds directly for App Store purchases.
• Free Trials: If a free trial is offered, it converts to a paid subscription unless canceled before the trial ends.

Price and Feature Changes

We reserve the right to modify subscription prices and the features included in any tier. Price changes will not affect existing subscribers until their next renewal period, and we will provide reasonable notice of any changes as required by the App Store. Where Apple requires it, a price increase takes effect only after you are notified and, where applicable, consent to the new price; if you do not agree, your subscription will not renew at the increased price.

Features may be added, changed, or removed over time, and we do not guarantee that any particular feature will remain available for the life of your subscription. If we materially reduce Pro functionality during your current paid period, you may cancel your subscription and may request a refund from Apple in accordance with Apple's refund policy.

Intellectual Property Rights

Our Rights

GoVenture — including its design, source code, branding, original content, and associated services — is owned by CoastalLabs and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Your Content

You retain ownership of the content you create in GoVenture, including trips, routes, photos, gear lists, notes, and posts ("Your Content"). By using the App, you grant CoastalLabs a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit Your Content solely as needed to operate the App and provide features you have enabled (such as cloud sync, group sharing, public route publishing, and feed visibility).

Public Routes and Shared Trips

If you publish a route to the public route feed or share a trip with a group, you grant other users the ability to view that content within the App according to the visibility settings you have chosen. You can unpublish or change visibility at any time, but copies that other users have already saved or downloaded may continue to exist on their devices.

Third-Party Map Data

Map tiles, terrain data, and related geographic information displayed in GoVenture are provided by third-party services and are subject to their own terms. You agree not to extract, scrape, or redistribute that data outside of normal use of the App.

Disclaimers and Outdoor Risks

Assumption of Risk

Outdoor activities involve serious and unavoidable risks, including but not limited to falls, lost or injured persons, exposure, hypothermia, heat illness, drowning, wildlife encounters, rockfall, avalanche, lightning, vehicle incidents, and equipment failure. By using GoVenture, you acknowledge these risks and agree that you are solely responsible for your safety and the safety of anyone in your party.

No Substitute for Skill or Judgment

GoVenture is a planning and tracking tool. It is not a substitute for:

• Proper navigation skills and a paper map and compass as a backup
• An emergency communication device (satellite messenger, PLB, or two-way radio) in areas without cellular coverage
• Appropriate physical fitness, training, and experience for the activity
• Up-to-date weather, conditions, and avalanche or wildfire reports from official sources
• Proper gear, food, water, and emergency supplies
• Verifying access, permits, closures, and land-management rules with the responsible agency

Accuracy of Routes, Maps, and Conditions

Routes, maps, distances, elevations, points of interest, weather forecasts, and any other information shown in the App may be incomplete, outdated, or inaccurate. User-submitted routes are not verified by CoastalLabs and may include errors, hazards, or rule violations. You should always verify routes and conditions before relying on them in the field.

GPS and Device Limitations

GPS accuracy varies depending on terrain, weather, satellite coverage, and device capabilities. Battery life, signal loss, hardware failure, or operating-system behavior can interrupt or corrupt route recording. Do not rely solely on the App for navigation, especially in remote, complex, or hazardous terrain.

No Emergency Service

GoVenture does not contact emergency services on your behalf. Float plans and emergency contact information are stored to help you and the people you designate, but the App does not automatically alert anyone if you fail to check in, stop moving, or trigger an alarm. In an emergency, use a phone, satellite messenger, PLB, or other dedicated emergency device.

Health and Fitness Information

Any health, fitness, or activity information shown in the App (including data from Apple Health) is for informational purposes only and is not medical advice. Consult a qualified healthcare professional before beginning or modifying any physical activity, particularly if you have a medical condition.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APP AND ALL RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
• COASTALLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOST DATA, LOST PROFITS, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO COASTALLABS FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
• WE ARE NOT RESPONSIBLE FOR INJURIES, ACCIDENTS, RESCUE COSTS, OR OTHER LOSSES SUSTAINED DURING ANY OUTDOOR ACTIVITY PLANNED, RECORDED, OR INFLUENCED BY USE OF THE APP.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless CoastalLabs and its affiliates, officers, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App and any outdoor activities you undertake
• Your violation of these Terms or applicable laws
• Content you submit, share, or publish through the App
• Your infringement of any third-party right, including intellectual property, privacy, or land-use rights

Data and Privacy

Your privacy is important to us. Our data collection, storage, and sharing practices are described in detail in our Privacy Policy, which is incorporated into these Terms by reference.

Data Backup

While GoVenture provides cloud synchronization for most data, you remain responsible for maintaining your own backups of trips, routes, and other content important to you. We recommend exporting critical trip plans and routes before strenuous activities or travel into remote areas.

Location and Health Data

The App requests location and (optionally) Apple Health permissions to provide its core functionality. You may revoke these permissions at any time through your device settings. Disabling these permissions may limit or disable certain features.

Service Availability

We strive to maintain high availability for the App and its supporting services, but we do not guarantee uninterrupted access. We reserve the right to:

• Modify, add, or discontinue features with reasonable notice
• Perform maintenance that may temporarily affect availability
• Suspend service in case of technical issues, security concerns, or abuse
• Limit the rate or volume of requests to protect the integrity of the service

Cellular and satellite coverage, device performance, and third-party services are outside of our control and may affect your ability to use certain App features in the field.

Termination

By You

You may stop using GoVenture at any time. To delete your account and the data associated with it, use the account deletion feature in the App or contact us directly. Account deletion permanently removes your trips, routes, photos, and other content as described in our Privacy Policy.

By Us

We may suspend or terminate your access to GoVenture if you violate these Terms, misuse the service, expose us or other users to legal or safety risk, or for other legitimate business reasons. Where reasonable, we will provide notice and an opportunity to address the issue.

Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.

Changes to Terms

We may modify these Terms from time to time. When we make significant changes, we will:

• Post the updated Terms at this URL
• Update the "Last updated" date
• Provide in-app notification for material changes
• Give you reasonable time to review changes before they take effect

Continued use of GoVenture after changes become effective constitutes your acceptance of the updated Terms. If you do not agree, you should stop using the App and may delete your account.

Apple App Store Terms

If you obtained GoVenture through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and CoastalLabs only — not Apple. Apple is not responsible for the App or its content.
• Your use of the App must comply with the Apple Media Services Terms and Conditions and any usage rules established by Apple.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution

Before filing any legal action, we encourage you to contact us directly so we can try to resolve the issue. Most concerns can be resolved through direct communication. If a dispute cannot be resolved informally, the parties agree to attempt resolution through mediation before pursuing other remedies, where permitted by law.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoastalLabs regarding GoVenture and supersede any prior agreements on the same subject.
